These Terms of Service ("Terms") govern your use of the Tradechase website and app (the "Service"), operated by RorysWork Ltd, a company registered in England & Wales (company number 17100750) with its registered office at Wegnall's Mill, Presteigne, Powys, LD8 2LD ("Tradechase", "we", "us"). Please read them carefully. By creating an account or using the Service, you agree to these Terms.
1. Acceptance of these Terms
If you do not agree to these Terms, you must not use the Service. If you use the Service on behalf of a business, you confirm that you have authority to bind that business to these Terms.
2. The Service
Tradechase helps tradespeople follow up on their quotes and invoices by scheduling and sending reminder messages to their own customers by email and SMS. The Service may connect to your email account to send messages on your behalf. Features may change, be added, or be removed as the Service develops.
3. Accounts & eligibility
- You must be at least 18 years old and use the Service for business purposes.
- You must provide accurate information and keep your account details up to date.
- You are responsible for keeping your login credentials secure and for all activity that happens under your account. Tell us promptly if you suspect any unauthorised use.
4. Early access
The Service is currently offered free of charge during an early-access period. During this time features may change and the Service is provided without any guarantee of availability or uptime. We may introduce paid plans in future; if we do, we will give you notice before any charges apply, and you will be free to stop using the Service.
5. Your content & data
You retain ownership of the content and data you add to the Service — your customers, jobs, quotes, documents, and messages. You grant us a limited licence to host, process, and transmit that content solely to provide the Service to you.
Where the content includes personal data about your customers, you are the data controller and we act as your data processor. How we handle personal data is described in our Privacy Policy.
6. Your responsibilities when messaging
Tradechase is a tool for contacting your own customers about work you are doing or have quoted for. Because the messages are sent from you, you are responsible for them. In particular, you agree that:
- You have a lawful basis to hold your customers' contact details and to contact them by email and SMS, in line with the UK GDPR and the Privacy and Electronic Communications Regulations (PECR).
- You will only message people who expect to hear from you, and you will honour any opt-out requests.
- You will not use the Service to send spam, unsolicited bulk marketing, or unlawful messages.
- You are responsible for the accuracy of contact details and the content of the messages you send.
- You will comply with the terms of any connected service (such as Google and Twilio).
7. Acceptable use
You must not:
- Use the Service for any unlawful, fraudulent, harassing, or deceptive purpose.
- Impersonate any person or misrepresent your identity or your relationship to a recipient.
- Upload malware, or attempt to disrupt, overload, or gain unauthorised access to the Service.
- Reverse engineer, copy, or resell the Service except as permitted by law.
- Use the Service in a way that could damage its reputation or that of its providers.
8. SMS credits
SMS messages are sent using credits allocated to your account. Credits have no cash value, are not exchangeable for money, and are non-transferable. We may change how credits are allocated or priced, and will give you reasonable notice of material changes. Message delivery also depends on the recipient's network and is not guaranteed.
9. Third-party services
The Service relies on third-party providers, including Google, Twilio, Supabase, and Cloudflare. Your use of features that depend on those providers is also subject to their terms. We are not responsible for the acts, omissions, or availability of third-party services.
10. Intellectual property
The Service, including its software, design, branding, and content (excluding your own content), is owned by Tradechase and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms. You may not use our name or branding without our permission.
11. Disclaimers
The Service is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, or that any message will be delivered, or that using it will result in you winning work, getting paid, or receiving reviews. Nothing in the Service constitutes legal, tax, or professional advice.
12. Limitation of liability
Nothing in these Terms limits or excludes our liability where it would be unlawful to do so — including liability for death or personal injury caused by our negligence, or for fraud.
Subject to that, we are not liable for any indirect or consequential loss, or for loss of profits, revenue, business, goodwill, or data. Our total liability to you arising out of or in connection with the Service is limited to the greater of (a) the total amount you have paid us for the Service in the 12 months before the claim, or (b) £100.
13. Suspension & termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if necessary to protect the Service or other users. On termination, your right to use the Service ends; sections that by their nature should survive (including data ownership, disclaimers, and limitation of liability) will continue to apply.
14. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date above, and for significant changes we will let you know within the app or by email. Continuing to use the Service after changes take effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute, except that if you are a consumer you may also bring proceedings in your own place of residence.
